Flat fees for standard tasks
Where we can, we want to streamline the trademark application process for you. That means, for a use-based, uncontested application, we bill you once: when the application is filed. While not all filing scenarios will fit this model, we will do our best to prevent the endless trickle of small invoices that other firms seem wedded to. We will also offer bulk rates for filing multiple applications or handling multiple maintenance or renewal filings.
Two heads are better than one
We live in a household where we talk trademarks all the time. We really mean it: When our eldest daughter, a toddler in the late 90s but already an experienced air traveler, spotted a United ticket office at a shopping center, she yelled out “that’s the airport!” We live this stuff and love it, and that’s why we are delighted to work together and combine our strengths. For example, Jessica’s assessment of a trademark’s availability is measurably enhanced by Marc’s calculation of infringement risk; conversely, Marc’s analysis of an infringement challenge is bolstered by Jessica’s examination of any registrations at issue.
Practical advice
Sometimes you don’t need a federal trademark registration. Sounds strange, but it’s true. Not all trademark lawyers will tell you that – but we will. We’ll tell you if your application is going to encounter obstacles in prosecution, we’ll tell you if it’s not a distinctive mark, we’ll warn you about the failure to function doctrine, and we’ll tell you you’ll have trouble overcoming refusals in certain countries because the lawyers don’t like to disagree with the government! How trademarks work is not as straightforward as you might think, and our goal is to clarify and simplify the process for you.
